Terms of Use (English)

Last updated: August 2026 — These Terms of Use (“Terms”) govern access to and use of Kashif Al-Arqam (“Kashif”, “we”, “us”, “the Platform”) at https://kashif-alarqam.com/.

By accessing or using the Platform — including phone search (Kashef), submitting reports or objections, contacting us, or browsing content — you agree to these Terms and our Privacy Policy. If you do not agree, stop using the Platform immediately.

1. Who we are

2. Nature of the service (important)

Kashif is a community-oriented information and safety tool. It aggregates and displays labels, reports, and educational content related to phone numbers. It is not:

  • a government registry or official telecom database;
  • a law-enforcement, court, or investigative authority;
  • a guarantee that any name, label, or report is complete, current, or correct.

Search results and community reports are assistive information. You must use independent judgment and official channels when decisions have legal, financial, or safety consequences.

3. Eligibility

You must be at least 16 years old (or the minimum age required in your jurisdiction) to use the Platform. If you use the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Account-free access & verification

Basic search may not require registration. Certain features (for example objections or ownership verification) may require OTP / phone verification, evidence uploads, or other checks. You must provide accurate information for those flows and keep verification codes confidential.

5. Acceptable use

You agree to use the Platform only for lawful, good-faith purposes consistent with public safety and privacy. You must not:

  • harass, stalk, dox, threaten, or unlawfully identify individuals;
  • submit false, misleading, defamatory, or malicious reports or objections;
  • upload illegal content, malware, or evidence containing unnecessary sensitive data;
  • scrape, bulk-harvest, or systematically extract data without our prior written permission;
  • bypass rate limits, App Check, CAPTCHA, or other security controls;
  • interfere with Platform availability, integrity, or other users;
  • use results for unlawful discrimination, fraud, or commercial spam;
  • impersonate another person or misrepresent affiliation with Kashif.

We may rate-limit, block, remove content, reject submissions, or restrict access where we reasonably believe these Terms or applicable law were violated.

6. Reports, objections & user content

When you submit a report, objection, contact message, evidence file, or other content (“User Content”), you represent that:

  • you have the right to submit it;
  • it is submitted in good faith and is as accurate as you reasonably know;
  • it does not violate others’ rights or applicable law.

You grant Kashif a worldwide, non-exclusive, royalty-free license to host, store, process, moderate, display, and (where relevant) publish User Content as needed to operate and improve the Platform, enforce these Terms, and comply with law. Moderation decisions (approve, reject, edit display labels, remove) are at our reasonable discretion.

An accepted objection aims to correct disputed display information; it is not a promise to delete all historical records where retention is needed for integrity, abuse prevention, or legal defense.

7. Intellectual property

The Platform’s software, design, logos, trademarks, editorial articles, and curated databases (excluding User Content you own) are owned by Kashif or its licensors. You may not copy, reverse engineer, resell, or commercially exploit Platform materials except as expressly allowed by these Terms or applicable law (e.g., fair use / quotation for commentary).

8. Third-party services & advertising

The Platform may rely on third-party hosting, CDNs, analytics, security (including App Check), messaging, and advertising networks. Those services have their own terms and privacy practices. Ads may appear to fund free access; ad partners may use cookies or similar technologies as described in the Privacy Policy.

External links are provided for convenience; we are not responsible for third-party sites or apps.

9. Privacy

Personal data is processed as described in our Privacy Policy, which forms part of your agreement with us when you use the Platform.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that results will meet your expectations.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KASHIF AND ITS OPERATORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE PLATFORM OR RELIANCE ON ANY RESULT OR REPORT.

Where liability cannot be excluded, our aggregate liability for claims relating to the Platform shall not exceed the greater of (a) the amount you paid us (if any) in the 12 months before the claim, or (b) USD 50 (or equivalent).

Some jurisdictions do not allow certain limitations; in those cases, limits apply only to the fullest extent permitted.

12. Indemnification

You agree to defend and indemnify Kashif and its operators against claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your misuse of the Platform, or your violation of these Terms or applicable law.

13. Suspension & termination

We may suspend or terminate access (in whole or part) immediately if we reasonably believe you breached these Terms, created security/abuse risk, or if required by law. You may stop using the Platform at any time. Provisions that by nature should survive (IP, disclaimers, liability limits, indemnity) survive termination.

14. Changes to the service or Terms

We may modify features, availability, or these Terms. Material changes will be reflected by updating the “Last updated” date (and may be highlighted on the site). Continued use after changes constitutes acceptance of the updated Terms.

15. Governing law & disputes

These Terms are governed by the laws applicable at the place of the Platform’s primary operations, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise. Courts with competent jurisdiction there shall have exclusive venue for disputes, unless mandatory law gives you a right to bring claims in your local courts.

Nothing in these Terms limits rights you may have under mandatory consumer, privacy, or e-commerce laws that cannot be waived by contract.

16. Severability & entire agreement

If any provision is held unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and any feature-specific notices, constitute the entire agreement between you and Kashif regarding the Platform.

2. طبيعة الخدمة (مهم)

كاشف أداة معلومات وسلامة مجتمعية. تجمع وتعرض تسميات وبلاغات ومحتوى توعوي مرتبطاً بأرقام الهواتف. وهي ليست:

  • سجلاً حكومياً أو قاعدة بيانات رسمية لشركات الاتصالات؛
  • جهة تحقيق أو قضاء أو إنفاذ قانون؛
  • ضماناً بأن أي اسم أو تصنيف أو بلاغ كامل أو محدّث أو صحيح دائماً.

النتائج مساعدة؛ اتخذ قراراتك بحكمة واستعن بالقنوات الرسمية عند الحاجة القانونية أو المالية أو الأمنية.

3. الأهلية

يجب أن يكون عمرك 16 عاماً على الأقل (أو الحد الأدنى المطلوب في بلدك). إذا استخدمت المنصة باسم جهة، فأنت تقر بأن لديك صلاحية إلزامها بهذه الشروط.

4. الوصول والتحقق

قد لا يتطلب البحث الأساسي تسجيلاً. بعض الميزات (مثل الاعتراض أو توثيق الملكية) قد تتطلب OTP أو مرفقات أو فحوصات أخرى. قدّم معلومات صحيحة واحفظ رموز التحقق بسرية.

5. الاستخدام المقبول

استخدم المنصة لأغراض مشروعة وبحسن نية. يُحظر عليك:

  • المضايقة أو التتبع أو التهديد أو إفشاء بيانات شخصية بشكل غير مشروع؛
  • تقديم بلاغات أو اعتراضات كاذبة أو مضللة أو كيدية؛
  • رفع محتوى غير قانوني أو برمجيات ضارة أو أدلة تتضمن بيانات حسّاسة بلا ضرورة؛
  • جمع البيانات آلياً (scraping) أو استخراجها بشكل منهجي دون إذن كتابي مسبق؛
  • تجاوز حدود المعدل أو أدوات الحماية (مثل App Check)؛
  • الإضرار بتوفر المنصة أو سلامة بياناتها أو بمستخدمين آخرين؛
  • استخدام النتائج للتمييز غير المشروع أو الاحتيال أو الإزعاج التجاري؛
  • انتحال صفة الغير أو الادعاء بتمثيل المنصة دون حق.

يحق لنا تقييد الاستخدام أو حظره أو رفض/إزالة المحتوى عند الاشتباه المعقول بمخالفة هذه الشروط أو القانون.

6. البلاغات والاعتراضات ومحتوى المستخدم

عند إرسال بلاغ أو اعتراض أو رسالة أو دليل، فإنك تقر بأن لديك الحق في إرساله، وأنه بحسن نية ودقيق بقدر علمك المعقول، ولا ينتهك حقوق الغير أو القانون.

تمنح المنصة ترخيصاً غير حصري وعالمياً ومجاني لإيواء وتخزين ومعالجة ومراجعة وعرض محتوى المستخدم حسب الحاجة لتشغيل المنصة وتحسينها وتطبيق الشروط والامتثال للقانون. قرارات المراجعة ضمن تقديرنا المعقول.

قبول الاعتراض يهدف لتصحيح معلومات العرض المتنازع عليها، وليس وعداً بحذف كل السجلات التاريخية إن لزم الاحتفاظ لأجل النزاهة أو منع الإساءة أو الدفاع النظامي.

7. الملكية الفكرية

برمجيات المنصة وتصميمها وعلاماتها ومقالاتها وقواعد بياناتها المنسّقة (باستثناء محتوى المستخدم الذي تملكه) ملك للمنصة أو مرخّصيها. لا يحق لك نسخها أو هندستها عكسياً أو إعادة بيعها أو استغلالها تجارياً إلا بما تسمح به هذه الشروط أو القانون.

8. خدمات الطرف الثالث والإعلانات

قد تعتمد المنصة على استضافة وشبكات توصيل وتحليلات وأمان ورسائل وإعلانات لجهات ثالثة لها شروطها وسياسات خصوصيتها. قد تُعرض إعلانات لتمويل الوصول المجاني. الروابط الخارجية للتيسير ولسنا مسؤولين عن مواقع الغير.

9. الخصوصية

تُعالَج البيانات الشخصية وفق سياسة الخصوصية، وتُعد جزءاً من اتفاقك معنا عند استخدام المنصة.

10. إخلاء الضمانات

تُقدَّم المنصة «كما هي» و«حسب التوفر» دون ضمانات من أي نوع إلى أقصى حد يسمح به القانون، بما في ذلك ضمانات الملاءمة لغرض معيّن أو عدم الانتهاك. لا نضمن خلواً من الأخطاء أو أن النتائج ستطابق توقعاتك.

11. حدود المسؤولية

إلى أقصى حد يسمح به القانون، لا تتحمل المنصة أو مشغّلوها المسؤولية عن الأضرار غير المباشرة أو العرضية أو الخاصة أو التبعية أو عن خسارة الأرباح أو البيانات أو السمعة الناتجة عن استخدامك للمنصة أو الاعتماد على أي نتيجة أو بلاغ.

حيث لا يمكن استبعاد المسؤولية، لا يتجاوز إجمالي مسؤوليتنا عن المطالبات المتعلقة بالمنصة أكبر القيمتين: (أ) ما دفعته لنا إن وُجد خلال 12 شهراً قبل المطالبة، أو (ب) ما يعادل 50 دولاراً أمريكياً.

12. التعويض

توافق على تعويض المنصة ومشغّليها عن المطالبات والخسائر والنفقات (بما فيها أتعاب قانونية معقولة) الناشئة عن محتوى المستخدم الذي تقدّمه أو إساءة استخدامك أو مخالفتك لهذه الشروط أو القانون.

13. الإيقاف والإنهاء

يحق لنا إيقاف أو إنهاء الوصول فوراً عند الاشتباه المعقول بالمخالفة أو عند وجود خطر أمني/إساءة أو بموجب القانون. يمكنك التوقف عن الاستخدام في أي وقت. البنود التي بطبيعتها تستمر (الملكية الفكرية، إخلاء الضمان، حدود المسؤولية، التعويض) تبقى سارية بعد الإنهاء.

14. التعديلات

قد نعدّل الميزات أو التوفر أو هذه الشروط. يُحدَّث تاريخ «آخر تحديث» عند التغييرات الجوهرية. استمرارك في الاستخدام بعد التحديث يعدّ قبولاً للشروط المعدّلة.

15. القانون والاختصاص

تخضع هذه الشروط لقوانين مقر تشغيل المنصة الأساسي، مع مراعاة قواعد حماية المستهلك الإلزامية في بلدك إن انطبقت. يكون للاختصاص القضائي المختص هناك الولاية على النزاعات، ما لم يمنحك القانون الإلزامي حق التقاضي محلياً.

لا تحدّ هذه الشروط من حقوقك الإلزامية بموجب قوانين المستهلك أو الخصوصية التي لا يجوز التنازل عنها تعاقدياً.

16. قابلية الفصل والاتفاق الكامل

إذا بطل بند، تبقى بقية البنود سارية. تشكّل هذه الشروط مع سياسة الخصوصية وأي إشعارات خاصة بالميزات الاتفاق الكامل بشأن استخدام المنصة.
